These are the terms and conditions for:

• Octohide VPN mobile application (Available on Google Play, App Store and AppGallery)

• Octohide VPN website (https://octohide.com)

The following user agreement applies to the use of the Octohide VPN platform and the services available on the platform. By using the platform and our services, you agree to these terms and conditions and our privacy policy.

In this user agreement, the words “platform” refer to the Octohide VPN mobile application and the Octohide VPN website together, "we", "us", "our", and "Octohide VPN", refers to Octohide VPN, and "you", and "user", refers to you, the user of Octohide VPN.

PLEASE READ THIS SERVICE AGREEMENT CAREFULLY BEFORE USING THE SERVICES AND FEATURES AVAILABLE ON THE PLATFORM.  

1. ACCEPTANCE OF TERMS

By accessing and using the Octohide VPN platform, you agree to be fully bound by the terms and conditions set forth in this user agreement. If you do not agree to any of the terms, you must refrain from using the platform or its services. We reserve the right to amend or update this User Agreement at any time. Any such modifications shall take effect upon their publication on the platform. Continued access to or use of Octohide VPN after the posting of modifications constitutes your express acknowledgment and acceptance of the updated terms. 

By using the platform, you represent and warrant that you have full legal capacity, power and authority to enter into this user agreement and to perform your obligations hereunder. You further confirm that you are not subject to any legal, contractual or other restriction that limits or prevents your ability to accept these terms and conditions. You warrant that you will use the platform in accordance with applicable laws and regulations and that your use will not infringe any third party rights or contravene any applicable regulations. 

Your acceptance of this user agreement constitutes a binding commitment by you and any entity you represent to adhere to the terms set forth herein and any additional policies posted on the platform. This commitment includes your obligation to ensure that all information provided during registration and use of the platform is truthful, accurate and up to date. Octohide VPN will not be liable for any breach of these terms by users, and any violation of these terms may result in the suspension or termination of your access to the platform.

2. DESCRIPTION OF THE PLATFORM 

Octohide VPN is an application operated and owned by UAB Digiteka, based in Lithuania, which offers a virtual private network (VPN) service designed to protect users' online privacy and security by encrypting Internet traffic and hiding their real IP address. By routing the connection through servers located in different countries, Octohide VPN allows users to simulate virtual locations, enhance digital privacy, and access geo-restricted content. The service is available in both free and monthly or annual subscription modes (Octohide VPN VIP), which can be purchased through in-app purchases on official platforms such as Google Play, App Store, and AppGallery, or by purchasing VIP tokens through our web store or authorized distributors. Octohide VPN may display ads to users of the free version and is committed to providing a safe, fast, and reliable experience for all users, regardless of subscription type.

3. REGISTRATION AND USER ACCOUNT

To start using the Octohide VPN app, you don't need to register. The app is free and available to all users without the need to create an account. However, if the user wishes to purchase the premium version of the service (Octohide VPN VIP), either by purchasing a subscription within the app or by redeeming a VIP token, it will be necessary to complete the registration process by providing a valid email address and creating a secure password.

Users who decide to register are responsible for providing accurate, up-to-date, and complete information, as well as for maintaining the confidentiality of their login credentials. Access to the account is personal and non-transferable, and users agree not to share their login details with third parties or allow unauthorized use of their account. Octohide VPN reserves the right to suspend or delete accounts in the event of misuse or violation of these terms and conditions. Users may close their accounts at any time from the application settings, and all associated information will be securely deleted in accordance with our privacy policy.

4. SUBSCRIPTIONS

Octohide VPN offers its users the possibility of accessing advanced features by purchasing subscriptions under the Octohide VPN VIP plan, available with monthly or annual billing. These subscriptions are purchased exclusively through in-app purchases using the payment methods offered by the official distribution platforms, such as Google Play for Android devices, App Store for iOS devices. Upon confirmation of purchase, the corresponding amount will be automatically charged to the payment method associated with the user's account in the respective app store.

All subscriptions are subject to automatic renewal at the end of each billing period, unless the user cancels the renewal in advance. Subscription cancellation must be done directly from the subscription settings of the user's account in the corresponding app store. Once the renewal has been canceled, the user will continue to have access to the benefits of the Octohide VPN VIP plan until the end of the period already paid for. All sales, including but not limited to initial purchases, renewals, and upgrades of the Octohide VPN VIP plan, are final. Except as required by applicable law or otherwise expressly permitted at the sole discretion of Octohide VPN, no refunds will be issued under any circumstances.

In the event that a subscription renewal is canceled, the user will retain access to the benefits and features of the Octohide VPN VIP plan for the remainder of the billing period already paid for. No refunds, whether full, partial, or prorated, shall be granted for any unused portion of the subscription term.

Octohide VPN reserves the right, but is not obligated, to make exceptions to this policy in limited and exceptional cases, at its sole and exclusive discretion.

Octohide VPN does not directly manage payments or renewals, so any issues related to charges, refunds, cancellations, or changes to the payment method must be handled through the official channel of the store from which the subscription was purchased. The user is responsible for reviewing the applicable terms in the relevant store and ensuring that their billing information is up to date.

Access to premium features will only be available while the subscription is active and payment is correctly processed. 

5. ACCEPTABLE USE OF THE SERVICE

The Octohide VPN service must be used responsibly, legally, and in accordance with these terms and conditions. The user agrees to use the platform solely for legitimate purposes and in compliance with the laws, regulations, and rules applicable in their jurisdiction and in the jurisdiction from which they access or use the service. Any use of the service that compromises the security, integrity, availability, or legality of the platform, other users, or third parties is strictly prohibited.

The user must not use Octohide VPN for activities that may be considered abusive, illegal, fraudulent or that infringe the rights of third parties. In particular, the use of the service is prohibited for:

• Participating in illegal activities, including but not limited to fraud, distribution of malware, identity theft, money laundering or unauthorized access to systems or networks.

• Transmitting, distributing, or storing content that is defamatory, abusive, threatening, obscene, violent, offensive, discriminatory, or that infringes on the intellectual property rights, privacy, or other rights of third parties.

• Send, publish or transmit through the service any content that is illegal, hateful, threatening, insulting, defamatory, incites violence, invades the privacy of third parties or violates any intellectual property rights.

• Upload, download, publish, reproduce or distribute any content protected by copyright or other property rights without the express authorization of the owner of such rights.

• Upload, download, publish, reproduce or distribute content that contains sexual or explicit representations of minors, in any form or context.

• Circumvent geographical restrictions imposed by platforms or services in order to access content in a manner contrary to their terms of use.

• Use the platform to send spam, unsolicited bulk emails, unauthorized commercial messages, or engage in any type of prohibited advertising.

• Reverse engineer, decompile, modify, or interfere with any part of the software, servers, or network protocols used by Octohide VPN.

• Use the service in an automated manner, including the use of bots, scripts, or automated tools to generate or maintain VPN connections.

• Participate in denial of service (DDoS) attacks, distribution of malicious software, or any attempt to negatively affect the performance of the service.

• Attempt to access, scan, breach, or connect to computer devices, servers, or networks without proper authorization.

• Participate in any conduct that interferes with, limits, or restricts the use of the service by other users.

• Share access credentials with third parties or allow simultaneous use of the account by multiple people.

• Use the service for any purpose contrary to local, national, or international law.

Failure to comply with this clause may result in the immediate suspension or permanent termination of the user's account, without prior notice and without the right to any refund. Octohide VPN reserves the right to investigate any suspected misuse and to cooperate with the competent authorities if required. The platform shall not be liable for any direct or indirect damage resulting from the unauthorized or prohibited use of the service by users.

6. ABUSE OF CONNECTION AND RECONNECTION TO THE SERVER

The use of the Octohide VPN service must be carried out in a balanced manner and with respect for the technical infrastructure of the platform and other users. Frequent, repetitive, or excessive connections and reconnections to VPN servers, especially when not in line with reasonable use of the service, may be interpreted as abusive behavior and contrary to these terms and conditions. This type of behavior can generate unnecessary load on the network, affect the overall performance of the service, and impair the experience of other users. Therefore, Octohide VPN reserves the right to monitor connection patterns and, when it detects abnormal or disproportionate use, may limit, temporarily suspend, or restrict access to the account involved, without prior notice, in order to protect the stability, efficiency, and fairness of the service for all of its users.

7. LIMITATION OF LIABILITY

Octohide VPN provides a virtual private network service intended to enhance the user's online privacy, security, and freedom by encrypting Internet traffic and hiding the IP address. However, the user acknowledges and agrees that the service is provided “as is” and “as available,” without warranties of any kind, either express or implied, including, but not limited to, warranties of uninterrupted operation, accuracy, suitability for a particular purpose, or absence of errors or vulnerabilities. Octohide VPN does not guarantee that the service will be available at all times or that it will meet the individual expectations of the user, nor that the server network will be free from interruptions, blockages by third parties, delays or loss of connectivity.

Octohide VPN shall not be liable in any case for any direct, indirect, incidental, consequential, punitive or special damages, including, but not limited to, loss of data, loss of income, business interruption, unauthorized access to personal information, misuse of the service by the user or third parties, or any other consequences arising from the use or inability to use the service. This applies even in cases where Octohide VPN has been advised of the possibility of such damages. Furthermore, the user acknowledges that the use of the service to access restricted content, circumvent geographic restrictions, or interact with third-party services is at their sole risk, and Octohide VPN shall not be liable for the consequences arising from such uses or for the legality of the activities that the user carries out through the service.

Octohide VPN does not collect or store records of browsing history, content viewed, DNS queries, or specific traffic generated by the user, and therefore cannot guarantee the recovery, restoration, or verification of such information under any circumstances. Similarly, it shall not be liable for any decisions or actions taken by the user based on the use of the application or for any errors arising from the interpretation, technical operation, or configuration of the user's device.

8. LICENSE & INTELLECTUAL PROPERTY

Octohide VPN grants users a personal, non-transferable, non-sublicensable, non-exclusive, revocable license to download and use its mobile application and related updates, solely in accordance with these Terms. Users must use the platform lawfully and refrain from any activity that is fraudulent, harmful, disruptive, or that infringes the rights of Octohide VPN, its affiliates, or third parties. Any unauthorized use may result in immediate suspension or termination of access, and Octohide VPN reserves the right to pursue legal action.

All rights, titles, and interests in the Octohide VPN app - including source code, design, trademarks, graphics, content, and other protected elements - are the exclusive property of Octohide VPN or its licensors. Except for the limited license granted above, no ownership or intellectual property rights are transferred to users. Any unauthorized reproduction, modification, distribution, or exploitation of these protected elements is strictly prohibited and may lead to legal consequences.

9. DISCLAIMER OF WARRANTIES 

Due to the nature of the Internet, Octohide VPN provides and maintains the platform on an “as is”, “as available” basis and does not promise that use of the platform will be uninterrupted or error free. We shall not be liable to the user or any third party if we are unable to provide our platform and services for any reason beyond our control.

Our platform may from time to time contain links to other platforms which are not under the control of and are not maintained by us. These links are provided for your convenience only and we are not responsible for the content of those sites.

Except as provided above we can give no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.

You will be responsible for any breach of these terms by you and if you use the platform in breach of these terms you will be liable to and will reimburse Octohide VPN for any loss or damage caused as a result.

Octohide VPN shall not be liable for any amount for any failure to perform any obligation hereunder if such failure is due to the occurrence of any unforeseen event beyond its reasonable control, including, without limitation, Internet outages, communications outages, fire, flood, war or force majeure.

These terms do not affect your statutory rights as a consumer which are available to you.

Subject as aforesaid, to the maximum extent permitted by law, Octohide VPN excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Octohide VPN and Octohide VPN shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

• Any incorrect or inaccurate information on the platform.

• The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the platform or any product purchased through the platform.

• Any loss or damage resulting from your use or the inability to use the platform or resulting from unauthorized access to, or alteration of your transmissions or data in circumstances which are beyond our control.

• Any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

• Any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing or using content from the platform or from transmissions via emails or attachments received from Octohide VPN.

• All representations, warranties, conditions and other terms which but for this notice would have effect.

10. INDEMNIFICATION

You agree to defend and indemnify Octohide VPN and any of their directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

• Your breach of this agreement or the documents referenced herein.

• Your violation of any law or the rights of a third party.

• Your use of the platform.

11. CHANGES 

We may, at our sole discretion, modify the platform and these Terms at any time. While we may provide notifications of material changes, you remain responsible for reviewing and remaining informed of the current Terms. Your continued use of the platform constitutes your acknowledgment and acceptance of any modifications, which shall supersede all prior versions. Unless explicitly stated otherwise, all changes to these Terms shall apply to all users and take immediate effect.

12. PERSONAL DATA

Any personal information you submit in connection with your use of the platform as a user will be used in accordance with our privacy policy. See our privacy policy.

13. INTEGRATION CLAUSE

This agreement together with the privacy policy published by Octohide VPN, shall constitute the entire agreement between you and Octohide VPN concerning and governs your use of the platform.

14. SEVERABILITY

If any section of these terms is held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired. Our failure to enforce or delay in enforcing any provision of these terms at any time does not waive our right to enforce the same or any other provision in the future.

15. FORCE MAJEURE

Octohide VPN shall not be liable for any failure to perform due to causes beyond its reasonable control, including, without limitation, fortuitous events, acts of civil authorities, acts of military authorities, riots, embargoes, acts of nature and natural disasters, and other acts that may be due to unforeseen circumstances.

16. TERMINATION

Both the user and Octohide VPN acknowledge that failure to comply with these terms and conditions may result in termination of the agreement between both parties.

In the event of any non-compliance with these Terms by a user, Octohide VPN reserves the right to unilaterally terminate the user’s access to and use of the platform. If the user maintains any account, such account and all related data will be deleted upon termination. This action may be taken without prior notice, and the user shall automatically forfeit all rights to access or use the platform. Octohide VPN shall not be liable for any loss of data or information resulting from such termination.

In case of non-compliance by Octohide VPN: If Octohide VPN fails to comply with its obligations under the agreed terms and conditions, the User shall be entitled to terminate the agreement and stop using the platform. The user shall notify Octohide VPN in writing of the breach and allow a reasonable time for Octohide VPN to remedy the situation. If Octohide VPN does not remedy the breach within the set period, the user may proceed with the termination of the agreement.

Termination of the agreement shall not release either party from any obligations and liabilities that have arisen prior to the date of termination. 

Continued use of the platform after termination of the agreement by either party shall imply acceptance of the conditions set forth in the terms and conditions in effect at that time.

17. DISPUTE RESOLUTION

Any dispute, claim, or controversy arising between a user and Octohide VPN in connection with this user agreement, the use of the platform or the services provided, shall be resolved exclusively through alternative dispute resolution mechanisms, including mediation and arbitration, as detailed below.

First, both parties agree to use their best efforts to resolve any dispute informally. This includes direct communication between the parties involved to identify and address concerns or disagreements quickly and efficiently. Users may contact Octohide VPN through designated support channels to raise any disputes. The company commits to respond within a reasonable period of time, providing an opportunity to resolve the issue without resorting to formal procedures.

If the parties fail to resolve the dispute informally within thirty (30) days of initial notification of the dispute, the dispute will be submitted to mediation. The mediation shall be conducted before a neutral mediator selected by mutual agreement of the parties. If the parties are unable to agree on a mediator within an additional fifteen (15) days, a mediator shall be appointed through a recognized mediation agency. The costs of the mediation shall be shared equally between the parties, and the mediation shall be conducted in English and at a mutually agreed location or, if both parties agree, through a virtual platform.

If mediation does not result in a satisfactory resolution for both parties, the dispute shall be submitted to binding arbitration in accordance with the arbitration rules of the Arbitration Institute of the Vilnius Chamber of Commerce, Industry and Crafts (Vilnius Court of Commercial Arbitration), and the arbitral award shall be final and binding on both parties. The place of arbitration shall be Lithuania. The language of the arbitration shall be English. 

The arbitrator shall have exclusive authority to resolve the dispute, including determining the applicability and validity of these dispute resolution terms. The arbitrator's decision shall be final and binding on both parties, and may be entered as a judgment in any court of competent jurisdiction. Unless prohibited by applicable law, the parties agree to waive any right to bring the dispute in court or to participate in a class action.

This dispute resolution clause does not preclude Octohide VPN from seeking injunctive or equitable relief in the event of intellectual property rights infringement, misuse of the platform, or any act that may cause irreparable harm, in which case it may go directly to a court of competent jurisdiction without exhausting alternative dispute resolution mechanisms.

By accepting these terms, users expressly waive any right to a jury trial and agree that all disputes will be resolved in accordance with the procedures set forth in this clause, with the objective of minimizing the costs and time associated with formal litigation. The parties assume their own costs associated with mediation and arbitration, unless otherwise agreed or specifically provided by the arbitrator.

18. FINAL PROVISIONS

Your use of our platform and purchase of our products is conditioned upon your acceptance of and compliance with all of the terms and conditions set forth. This authorization to use our services does not extend to jurisdictions where these provisions are not respected or applied.

Our commitment to compliance with these terms is strictly governed by applicable laws and legal process. Importantly, these terms do not restrict our ability to comply with legal or governmental requirements, including but not limited to those relating to law enforcement and the use of our platform. Information provided or collected in connection with your use of the platform and purchase of our products will be subject to these requirements.

In the event that any provision of these terms and conditions shall be declared invalid, illegal or unenforceable by any court or competent authority, such decision shall not affect the validity or enforceability of the remaining provisions. The failure or delay in enforcing any of these terms and conditions by us at any time shall not constitute a waiver of our rights to enforce such provision, or any other provision, in the future.

We reserve all rights not expressly granted herein, while at all times maintaining the protection of and respect for our intellectual property rights and prerogatives.
